New Delhi: Google LLC on Wednesday filed a petition in the Delhi High Court seeking interim protection against its declaration as a ‘Social Media Intermediary’ (SMI) under the Information Technology (Intermediary Guidelines and Digital Code of Conduct) (IT Rules 2021) And argued that these rules do not apply to its search engine. Google challenged the order of a single-judge bench of the court, which directed it to globally remove the content, which was marked as ‘objectionable’ by a woman petitioner, for being objectionable. The petitioner claimed that the content was taken from his social media accounts on Facebook and Instagram and was circulated without his consent. The content was not completely removed from the World Wide Web despite a court order. The petition urged the High Court to set aside the order of the single judge.

A bench of Chief Justice DN Patel and Justice Jyoti Singh issued notices to the Centre, Delhi government, Facebook, Internet Service Providers Association, porn sites and women. The High Court has sought his reply in this matter by July 25.

Citing the April 20 decision, Google argued that it had misrepresented its search engine as a ‘social media intermediary’ or a ‘significant social media intermediary’ under the new rules for digital media. Has been provided.

Google said it was aggrieved by the blanket, template directive issued by the single judge. The search engine giant further argued that the judge mixed different sections of the IT Act and different rules laid down thereunder and passed template directions by combining all such offenses and provisions. However, the High Court said that it would not pass any interim order at this stage.
